1. Information Officer Details
The Information Officer of a private body is the head of the body. Duties may be delegated to a Deputy Information Officer; accountability remains with the head. Officers take up their duties after registration with the Regulator (POPIA section 55(2)).

2. Responsibilities
In terms of POPIA section 55(1) and Regulation 4, the Information Officer:
- encourages compliance with the eight conditions for lawful processing;
- deals with requests made under POPIA and PAIA;
- works with the Regulator on investigations;
- ensures a compliance framework is developed, implemented, monitored and maintained;
- ensures a personal information impact assessment is done;
- ensures the section 51 PAIA manual is developed, monitored, maintained and made available;
- ensures internal measures and systems exist to process requests;
- ensures internal awareness on POPIA and PAIA;
- handles security-compromise notifications under POPIA section 22; and
- responds to data-subject requests within the prescribed timeframes.
3. Your rights as a data subject
- Access — request confirmation and a copy of personal information held (POPIA section 23).
- Correction — request correction or update of inaccurate information (section 24).
- Deletion — request deletion where information is no longer required, subject to legal retention duties.
- Object — object to processing, including for direct marketing (section 11(3)).
- Withdraw consent — where processing is based on consent, without affecting prior lawful processing.
- Complain — lodge a complaint with the Information Regulator if information is processed unlawfully.

4. Legal alignment

5. PAIA and POPIA requests
PAIA access requests must be submitted on Form 2 (Request for Access to Record), available from inforegulator.org.za/paia-forms or from the Information Officer. Outcome and fees are notified on Form 3. The request fee for a private body is the prescribed amount (currently R140.00) unless you are requesting your own personal information.
POPIA objections and correction/deletion requests use the Regulator’s prescribed POPIA forms (Form 1 and Form 2).

If you are not satisfied with how we handle personal information or a request, you may complain to the Regulator. This does not affect your right to approach a court.
