Terms of Service

1. Preamble

The following Terms of Service are a legal and binding contract applicable to all products and/or services undertaken by , trading as Learna™, for and on behalf of any Client who has purchased a product or service through our website.

2. Definitions

The singular includes the plural and vice versa. A reference to any gender includes a reference to the other gender. Headings are for convenience only. “Including” is not limiting. Company means trading as Learna™. Consumer Protection Act 68 of 2008 is the “CPA”. Client means the purchaser or end user. Business day means any day other than a Saturday, Sunday or South African public holiday. Sign / Signature includes an electronic signature as contemplated in ECTA. Website means learna.co.za and related domains. Campus means the FluentCommunity learning community on the Site.

3. The service specifications

All products and services are listed on the website complete with pricing and descriptions. The core services are a family subscription (child seats for Grade R–12 with Campus spaces and courses) and a teacher subscription (Campus access and optional Teacher Directory listing after verification). Learna™ is not a registered school.

4. Price

Prices of products and services on the website are valid until we change or remove the product. Prices are in South African Rand. Custom work, if ever quoted, is valid for 7 calendar days from the quotation date unless stated otherwise.

5. Acknowledgement

Upon purchasing a product or service from our website, the Client acknowledges that they have read, understand, and accepted these Terms of Service, the Terms and Conditions, the Privacy Policy and the Returns & Refunds Policy.

6. Agreement

The Client acknowledges acceptance of these Terms of Service by purchasing products or services through the website and paying the required fees via the stipulated payment gateways (including PayFast). Digital access commences when payment is confirmed.

7. Compatibility

The Site is designed to work on reasonably current browsers and devices. We do not warrant a particular device, browser or assistive-technology combination.

8. Payment

Subscription fees are payable in advance for the selected billing period. Recurring charges are collected by the payment gateway under its terms. Failure to pay may result in the subscription being paused or cancelled and Campus access withdrawn for the payer and linked learners.

9. Breach and termination

If the Client breaches these terms and fails to remedy the breach within a reasonable time after notice, we may suspend or terminate the service. We may terminate immediately where child safety or fraud is involved.

10. Force majeure

Neither party is liable for delay or failure to perform caused by circumstances beyond reasonable control, including load-shedding beyond backup capacity, third-party hosting or payment outages, and acts of God.

11. Required documentation

Teachers who apply to be listed must submit the documents we specify, which may include identity, SACE, qualifications, police clearance, and proof of South African citizenship or permanent residence.

12. Copyrights and trademarks

See the Copyright Notice. The Client may use Content only as licensed in the Terms and Conditions.

13. Graphic images and photographs

Images supplied by teachers or parents remain their responsibility. Default avatars and covers are provided by us until replaced.

14. Hosting of Campus

Campus and course hosting is provided as part of an active subscription. We do not warrant uninterrupted hosting. Maintenance windows may occur.

15. Third-party platforms

PayFast, FluentCommunity and other operators have their own terms. After an approved teacher introduction, communication may move to WhatsApp or similar tools outside our control.

16. Licensing

Access to Campus and courses is a limited, non-transferable licence for the term of an active subscription and the seats purchased. It is not a sale of software.

17. Search and discovery

We do not guarantee search-engine ranking of the public Site or of any teacher listing.

18. Ecommerce

Checkout is processed through WooCommerce and the enabled gateway. Taxes are as displayed at checkout. One active family subscription and one active teacher subscription per customer account unless we agree otherwise.

19. Balance of payment

Where a custom invoice is issued, the balance is due as stated on that invoice. Subscription renewals are due on the billing date shown in My Account.

20. Service period

Monthly and yearly periods run from the date payment is confirmed unless My Account shows another next-due date after a renewal.

21. Additional work

Work outside the published subscription (for example custom content development) requires a separate written agreement.

22. Service agreement

Support is provided via the published contact channels during reasonable business hours on business days.

23. Invoices and statements

Invoices are available from My Account and by email where generated. PDF invoices are provided where the invoicing plugin is active.

24. Consultations

Any consultation beyond ordinary support may be billed if agreed in writing in advance.

25. Legal costs

A party in successful legal proceedings may recover costs as a court allows.

26. Cancellations and termination

The Client may pause, resume or cancel as described in My Account and the Returns & Refunds Policy. Cancel stops future gateway charges. Access ends when the subscription is no longer active.

27. Security

The Client must keep login credentials confidential and notify us of suspected unauthorised use. Children must not share passwords.

28. General

These Terms of Service, together with the Terms and Conditions and policies posted on the Site, constitute the agreement for paid services. South African law applies. Consumer rights that cannot be excluded remain.
